A. Suspension Hearing for Michael Burns

The Board voted to end the suspension of Mr. Burns as time served 1: Supervisor Leventry 2: Supervisor Nargi; 5-0

The Board authorized the funding agreement with Lyvwell for up to $20k 1:Supervisor Leventry 2:Supervisor Nargi; 5-0 Once the $20k threshold is met, there shall be no further work on Lyvwell (Sharyn highlighting this for you to note as well) .

B. Upland Claims – Matt Davis

1. Update on 530 Islebay- Rosser

Rosser (530 Islebay) – We do not have the results or analysis from the geotechnical engineer regarding the soil composition, stability and quality below Mr. Rosser’s retaining wall yet. However, the District Engineer continues to maintain that the cracking in the upland retaining wall relates back to the original seawall and was evident in 2017.

Authorize Burby to provide an estimate for George’s property (530 Islebay) to repair only the retaining wall 1: Supervisor Nargi 2: Supervisor Leventry; 5-0

Board direction to review 528, 530, 532 & 534 Islebay

Earth Tech warranty Claim – my understanding is that Earth Tech has been responsive to the warranty claim we made and has been in contact with the District Engineer about making the repairs. Lighthouse will be able to provide more information as there has been no reason for legal to get involved at this time due to Earth Tech’s responsiveness.

2. Update on Sport Surfaces

Sport Surfaces – The Complaint has been filed and we served Sport Surfaces with the Complaint on November 28. Per the Florida Rules of Civil Procedure, its response to the Complaint is due Monday, December 19. There will be more to report next month after we receive the response and understand how Sport Surfaces intends to defend its refusal to return the deposit.
