The CDD District Lawyers told me today that the Hecker contract is only for the replacement wall, it does not include the installation of rip-rap as voted on by the CDD Board on Jan 12th. I brought up this possibility at the meeting as a concern for delaying thus allowing more decay to occur to all the walls and especially all the uplands.
The lawyers told me that the level of funding for this new direction exceeds the amount that requires a new RFP to be voted on. Now a new RFP has to be drafted and then has to be voted on, passed, before it can go out for bid, then it has to be posted in the usual way with advertising the bids with the legal amount of time for bidders to respond. I asked the lawyers how much delay this caused, they agreed at least 60 days. Looking at our history this could drag on easily from 90 to 120 days before final contractor is approved.
The vote to use rip-rap, which I warned was the wrong direction because it is not cost effective in the long run. This has now put several lots already close to the engineers recommended level for an emergency fix in serious jeopardy and they will most likely cross that threshold with the delay, the delay also means we will continue to see the uplands deteriorate thus costing us even more.
I am fully aware there are residents who think my motivation is only for Option 3, I will reiterate that I am 100% concerned with the over all cost to all of us, not just one aspect for this problem, so I will repeat that I am concerned with the long term O&M of this community. My motivation is that no one in this community to have to pay more than we have to, or worse, twice.
