EPC Meeting

I met with the EPC on Friday Sept 8th, the same Gov’t agent who worked with Langan worked with me, here is a synopsis of that meeting

EPC Comments:

  • The permit can NOT be changed, we can ask for a new permit via the 2-month process but we will not see such a liberal permit this time around (her words) but until then the slope MUST meet; 2-1 or better.
  • Langan did not meet the 2-1 at the test site, (nor can they b/c of the simple geometry of the canal bottom). This was mentioned at beginning of the last board meeting (not by me) the slopes were greater than 2-1, so its on public record.
  • Size of rock utilized in test area is too small. There should be no rock smaller than 6”.
  •  It was noted that soil borings had been conducted and there is data available regarding the soil composition. While the soil in the canal system is not exactly the same, based on the soil borings. Langan noted it is homogeneous and would be considered sandy – silty but not clayey soils. As such, the concern regarding maintenance of the 2:1 slope the EPC acknowledged. It was expressed that the test site will provide additional information and that the 2:1 slope will be maintained according to the permit. (but we know it wasn’t)
  • To ensure no release of turbid water, double curtains were suggested. To reduce the amount of turbidity, a pre-wash statin should be utilized or either pre-washed rock.
  • Asked Langan about a Navigation study, they said there was no issues, —–yet we have the independent engineering firms report which Langan did not give the EPC, so I made sure they have it now, we all know it is not what Langan claimed to the EPC.
  • They are not pursuing enforcement at this time as this is a test site. However, if non-compliance persists formal proceedings may be initiated.
  • The process of hand placement of rip-rap around the mangroves was the expectation, it was to place the rock in the boom and it was not to be dumped but moved one and a time and placed around the root system. There were areas where the branches were “laid down”. This is not to take place.

 

Thus we are not yet off the hook from the enforcement department for a fine.

Plenty of facts out their proving Langan wrong at every turn and non-compliance with the permit in many areas of their own design!

So, Now we have more facts as to why a Governmental agency, EPC, sent us a non-compliance letter requiring the design is to be met and more importantly, will be enforced.
